Terms of Service
Last updated: September 2026
These terms govern your use of nebulasynth.com and any service, trial account, product, or software delivered by NebulaSynth LTD ("NebulaSynth", "we", "us"). By using our website, starting a trial, or purchasing a service, you agree to these terms.
1. Our services
NebulaSynth provides software development, website and e-commerce development, AI training and integration, and related technical services. Specific deliverables, timelines, and pricing for a project are agreed separately with each client, usually in a proposal, quote, or order confirmation. Where anything in a signed proposal conflicts with these terms, the proposal takes priority for that engagement.
2. Trial accounts
Some services are offered on a free trial basis. Trial length, included features, and what happens when a trial ends are shown in your account dashboard. We may suspend or limit a trial account that we reasonably believe is being used to abuse the service, including creating multiple trials to avoid payment.
A trial that ends without conversion to a paid plan may be frozen. Frozen accounts can usually be restored by completing payment; contact us if you believe your account was frozen in error.
3. Payments
Payments are collected through M-Pesa or Pesapal. Prices are shown in Kenyan Shillings unless stated otherwise. You are responsible for providing accurate payment details and for any charges from your mobile network or bank related to completing a payment.
Once a payment is confirmed by the payment provider, the corresponding service or access is activated. If a payment is later reversed, disputed, or found to be fraudulent, we may suspend the related service until the matter is resolved.
4. Refunds and cancellations
Refund eligibility depends on the type of service purchased and is set out in our Refund Policy. Custom development work already started or delivered is generally non-refundable, while product purchases and subscriptions follow the terms described there.
5. Acceptable use
You agree not to use our services to: break any applicable law, infringe someone else's intellectual property, distribute malware, attempt to gain unauthorized access to our systems or another user's account, or resell access to the service without our written agreement.
6. Intellectual property
Unless a project agreement says otherwise, custom software we build for a client becomes the client's property once paid for in full. NebulaSynth retains ownership of any pre-existing tools, frameworks, or components we reuse across projects, and grants the client a license to use them as part of the delivered work.
7. Availability and support
We aim to keep hosted services available at all times but do not guarantee uninterrupted access. Planned maintenance and unexpected outages may occur. Support scope and response times for a specific engagement are described in that engagement's own agreement.
8. Limitation of liability
To the extent permitted by law, NebulaSynth is not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim.
9. Changes to these terms
We may update these terms from time to time. Continued use of our services after an update means you accept the revised terms. Material changes will be reflected by updating the date at the top of this page.
10. Governing law
These terms are governed by the laws of Kenya. Any dispute arising from them will be subject to the jurisdiction of the courts of Kenya, unless a separate signed agreement states otherwise.
